Oliver's probation restrictions, rules laid out in court documents

Undergoing a sexual abuse treatment program is one of the many restrictions placed on former Graham Junior High teacher’s aide Allison Amber Oliver, who was given 10 years of community supervision and 180 days of jail time after being sentenced Tuesday.

Oliver pleaded guilty Monday in 90th District Court in Stephens County to three second-degree felony counts of sexual assault of a child. A change a venue was granted to Oliver in early August and the trial was moved to Stephens County.

After two days of proceedings the jury of 10 Breckenridge residents made their decision and Oliver was sentenced to 10 years in state jail per counts, to run concurrently, with the jury suggesting the sentence be suspended. Judge Jerry Ray did convert the jail time to 10 years of probation.

Oliver was sentenced to an immediate 180 days in the Stephens County Jail as a condition of probation. Her concurrent probation means all three counts will be served at once, so rather than 30 years probation, she will serve 10.

Background

In January of this year, Oliver was arrested on two warrants and was released on a $50,000 bond that day. The charges alleged Oliver had sexual relationship with a 14-year-old student while she was an employee at Graham Junior High School.

The warrants were the result of an investigation initiated by DARE/ School Resource Officer Ty Viehmann in October 2015, following a complaint made by Graham ISD. Graham Police Department Lt. Jim Reeves followed up on the investigation and made further findings into the case.

Oliver, who had worked for the school district since 2009, was fired in October 2015.

Young County Attorney Dee Peavy recused herself from prosecuting the case over a conflict of interest never disclosed publicly. Graham Chief of Police Tony Widner reported in January that special prosecutor Chuck Smith had been appointed to the case.

Terms of sentence

If Oliver violates her probation, she will have to pay a $30,000 fine. She was assigned 720 hours of community service at a rate of 12 hours per month.

Oliver will be registered as a sex offender and will be have to take a sexual abuse treatment program on an outpatient basis as ordered by the Community Supervision and Corrections Department of Stephens County.
