HOUSTON—Harris County has dropped its call for a preliminary injunction to keep a man from serving as an elected official, despite accusations that he misrepresented his race to voters and doesn't live in his district.

Assistant Harris County Attorney Robert Soard said Wednesday that the call was being dropped in an agreement with the attorney for newly elected Houston Community College trustee Dave Wilson. Soard says the issue over whether Wilson is qualified by residency to serve will be decided by a jury at a civil trial scheduled for April 15.

Last week, state District Judge Brent Gamble declined to grant a restraining order preventing Wilson from serving.

Wilson's opponent alleged mailers Wilson sent to voters in the predominantly black district implied Wilson, who is white, was black.
