King was one of two white supremacists condemned for the slaying of James Byrd Jr. The 49-year-old black man was chained to the back of a pickup truck in 1998 and fatally dragged.
Companion Russell Brewer was executed in 2011. A third man, Shawn Berry, is serving life.
King's case is before U.S. District Judge Richard Schell. The Beaumont Enterprise reports King's attorney, Richard Ellis, contends evidence showed King wasn't at the attack, that sandals with Byrd's blood didn't belong to King and that King had no intention of starting a racist group in Jasper.
State attorneys say the trial jury dismissed those arguments.
