Allen Lee Dixon pleaded guilty Monday to two felony charges of indecency with a child by sexual contact. As part of a plea agreement, he was arrested and sentenced to 180 days in the Young County Jail and 10 years deferred adjudication community supervision.
The charges stem from allegations made against Dixon while he was operating Brothers Smokehouse, a former restaurant in Graham which he co-owned. The offenses took place around May 1, 2020 and Nov. 1, 2021, with victims under the age of 18.
According to a release from the 90th Judicial District Attorney’s office, the charges originated from reports made to Graham Police Department alleging Dixon was committing acts of sexual abuse against minors and other employees at Brothers Smokehouse.
“During the investigation by the Graham Police Department, many other victims were identified stretching back to early 2000,” the DA’s office wrote.
The two charges of indecency with a child by contact were enhanced to first-degree felonies due to a prior Tarrant County felony conviction for driving while intoxicated, third or more. Dixon was sentenced to deferred adjudication community supervision for a period of 10 years in each case, to be served concurrently, with stacked possible prison sentences in the event he violates his probation conditions.
“Dixon will be facing possible consecutive sentences of up to 99 years or life in each case. Dixon must comply with approximately seventy-seven conditions of probation; one of which requires six months (180 days) confinement in the county jail,” the DA’s office wrote. “Other conditions of probation require that he enroll in and successfully complete an extensive sex offender treatment program. He is also subjected to immediate lifetime registration as a sex offender.”
Other conditions of community supervision include not residing within 1,000 feet of a school, playground or childcare center.
Dixon is also prohibited from being within 1,000 feet of a premises where children under the age 18 commonly gather, such as a school, daycare facility, playground and public or private youth center.
An exception to this condition is when Dixon is participating as a spectator in his own children and step-children’s extracurricular activities. While attending, he must have a “competent adult” to supervise the defendant at all times during the activities.
As a condition of his community supervision, Dixon is also barred from being employed by, managing or owning another restaurant.
“District Attorney Dee Peavy and Assistant District Attorney Phillip Gregory would like to thank Sgts. Kyle Ford and Hailey Calcote of the Graham Police Department for their tireless work in investigating these allegations,” the release stated. “Lastly, Ms. Peavy would like to thank Virginia’s House employees for their assistance with conducting forensic interviews with the child victims in these cases.”
Dixon was first arrested on a single charge of indecency with a child by sexual contact in September 2022. He was taken to jail Sept. 14, 2022 on a $50,000 bond, and bonded out the same day.
Dixon was indicted and arrested Nov. 4, 2022 on two charges of indecency with a child, under the age of 17, by sexual contact, with two separate victims, and one charge of solicitation of prostitution. He bonded out Nov. 5, 2022.
