PUC legal staff suggests rehearing denial for Graham wholesale customers

The Public Utility Commission of Texas legal staff last week released a reply to the city of Graham wholesale customers to deny a rehearing request involving a wholesale water dispute between the city of Graham and the customers which had a final decision by the PUC in July.

A final order was made by the PUC on the docket issue July 2 and found the wholesale water customers failed to meet their burden of proof to show that wholesale waters rates charged by the city of Graham were of adverse public interest under the Texas Water Code. In the reply to wholesale customers’ July 24 request for a rehearing, the staff stated that they supported the commission’s original decision in the preceding.

“The Commission’s Order is supported by substantial evidence, is in the public interest, and, is in compliance with the law. The Motion for Rehearing filed by Petitioners is without merit, fails to raise any new substantive issues, and should be denied,” the reply states.
